02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.568 of 2025 pending in the Court of learned S.D.J.M., Dhenkanal, arising out of Dhenkanal Town P.S. Case No.247 of 2025 for commission of offences punishable under Section 191(2)/191(3)/103(2)/111(2)(a)/190 of BNS, 2023 read with Sec.25/27 of Arms Act.

It is submitted by the learned counsel that omnibus allegations have been made. Hence, the Petitioner may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail referring to the statement of one of the witnesses, namely, Sapura Behera.

It is also submitted that the Petitioner has criminal antecedent.

It is stated at the Bar by Mr. Budhia, learned counsel for the Petitioner that four accused persons have been released on bail by the learned Court below on being taken into custody.

It is submitted by the learned counsel for the State on instruction that in the meanwhile steps for cancellation of bail have been initiated in respect of one of the accused persons.

It is stated that this Court is in seisin of the matter.

It is submitted by Mr. Budhia, learned counsel for the Petitioner that there is no motion in respect of other co-accused so released. Hence, the Petitioner may be protected by pre-arrest bail on the ground of parity.

Considering the nature of allegations and the materials on record, this Court is not inclined to entertain the application for pre-arrest bail.

Accordingly, the ABLAPL stands rejected.
