The matter was on board of this Court on 29.10.2025, wherein in spite of service of notice on the informant, the informant did not appear and accordingly another chance was given to the informant to put his stand before this Court and the matter was listed to this date i.e. on 02.12.2025, but there is no appearance on behalf of the informant on this day as well i.e. on 02.12.2025 when the matter was called.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with C.T No.2015 of 2024 pending in the Court of learned JMFC (V), Bhubaneswar, arising

out of Bharatpur P.S. Case No.726 of 2024 for commission of offence punishable under Sections 351(2)/296/318(4) of BNS, 2023.

It is submitted by the learned counsel that taking into account the nature of allegations and the background in which the same has been levelled, the Petitioner ought not to be subjected to custodial interrogation.

Learned counsel for the State opposes the prayer for pre-arrest bail.

Taking into account the nature of allegations and the punishment prescribed, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

It is needless to state that the Petitioner shall cooperate with the ongoing investigation.

Accordingly, the ABLAPL stands disposed of.
