Heard Mr. S.P. Mishra, learned counsel appearing for the Petitioners and Mr. C.K. Pradhan, learned Addl. Govt. Advocate along with Mr. C.M. Singh, learned Addl. Standing Counsel appearing for the Opp. Parties.

All these writ petitions have been filed inter alia challenging the notice dtd.05.11.2021, wherein claim of the Petitioners to get the benefit of appointment has been rejected on the ground of having not qualified the OSTET examination.

Learned counsel for the Petitioners contended that all the Petitioners failed to qualify the test for not securing the required mark by one mark and/or two marks and the subject matter is pending before this Court in W.P.(C) No. 34761 of 2021. It is contended that fate of the Petitioners in the present writ petitions is subject to final outcome of W.P.(C) No. 34761 of 2021. If Petitioners will succeed in W.P.(C) No. 34761 of 2021, then only the grievance as raised in the present writ petitions can be considered. It is

accordingly contended that Petitioners may be permitted to withdraw all the writ petitions with liberty to reiterate the prayer, if they ultimately succeed in W.P.(C) No. 34761 of 2021.

Learned State Counsel has no serious objection to the submission made by the learned counsel appearing for the Petitioners.

Having heard learned counsel appearing for the Parties and considering the submissions made, this Court while disposing all the writ petitions, grants liberty to the Petitioners to reiterate the prayer, if they ultimately succeed in W.P.(C) No. 34761 of 201.
