This matter is taken up through hybrid mode.

Grievance of the Petitioner in this writ petition is with regard to construction of a community center over village road in Plot No.971 under Khata No.201 (Sarba Sadharana), Kisam Road in mouza Saruali under Telkoi tahasil of Keonjhar district by the villagers.

It is submitted by Mr. Das, learned counsel for the Petitioner that due to illegal construction of the community hall over the aforesaid plot access to the house of the Petitioner would be completely blocked. Although the Petitioner has made grievance to the Tahasildar, Telkoi (Opposite Party No.3) in that regard, but no action has yet been taken on the same.

Pursuant to direction of this Court, Court affidavit has been filed by Tahasildar, Telkoi stating that construction made over the aforesaid plot is unauthorized. Thus, encroachment

proceedings have been initiated against the villagers for eviction of the encroachment.

Mr. Das, learned counsel for the Petitioner submits that in view of the counter affidavit filed no further grievance remains to be adjudicated in this writ petition. He, however, submits that steps should be taken by Tahasildar, TalkoiOpposite Party No.3 to dispose of the encroachment case and evict the encroachment at an early date.

Mr. Mishra, learned ASC submits that steps are being taken for disposal of encroachment proceedings and removal of encroachments.

Upon hearing learned counsel for the Petitioner and on perusal of record, this Court finds that encroachment case, i.e., OPLE Case No.4057 of 2024 has been initiated for eviction of encroachment from Plot No.971 under Khata No.201 (Sarba Sadharana), Kisam Road in mouza Saruali under Telkoi tahasil in the district of Keonjhar. Hence, this writ petition is disposed of with a direction that Tahasildar, Telkoi shall conclude the encroachment case, i.e., OPLE Case No.4-57 of 2024 in accordance with law, as expeditiously as possible, preferably within a period of four months from the date of production of certified copy of this order.
