1 . This matter is taken up through hybrid arrangement.

2 . In filing this Writ Petition, the Petitioners have sought for a direction from this Court to the Tahasildar, Simulia/Opposite Party No.3 for evicting the encroacher named Snehasis Panda/Opposite Party No.4 from the Government land in question.

3 . Learned counsel for the Petitioners makes an allegation that due to such unauthorized encroachment over the Government land in question by the Opposite Party No.4, the inhabitants of the locality are suffering a lot. The said land was being utilized for drainage purpose.

4 . He further contends that pursuant to the allegation made by the Petitioners on the selfsame issue, the Sub-Collector,

5 . At this juncture, learned counsel for the Petitioners alleges that despite the opinion given by the Sub-Collector, Balasore as well as the Collector, Balasore in this regard, the Tahasildar, Simulia is not taking appropriate steps for removal of encroachment.

Considering the above submission made on behalf of the Petitioners and looking to the factual scenario of the case, this Court directs the Tahasildar, Simulia/Opposite Party No.3 to take appropriate steps for free flow of water in the channel in question by removing the encroachment over the land in question.

7 . The entire action shall be completed within a period of one month from the date of presentation of an authenticated copy of this order.

8 . This Writ Petition is, accordingly, disposed of.
