1 . This matter is taken up through hybrid arrangement.

2 . The Petitioner has filed this Writ Petition seeking a direction from this Court to the Opposite Parties to appoint the Petitioner in any regular vacancy with the Opposite Parties under Rehabilitation Assistance Scheme or on Compassionate ground.

3 . Heard learned counsel for the Parties.

4 . The brief facts of the case is that the Arakhita Panda (Father of Petitioner) was serving as a messenger with the

Opposite Party No.4/ Branch Manager, State Bank of India, G.Udaygiri Branch (Main Branch) since 05.02.1988 and died of cancer while in service. Soon after the death of the deceased, his family approached the Opposite Party No.4/ Branch Manager, State Bank of India, G.Udaygiri Branch (Main Branch) for early payments of death benefits etc. The mother of the Petitioner submitted an application to the Opposite Party No.4/ Branch Manager, State Bank of India, G.Udaygiri Branch (Main Branch) on 30.03.2005 requesting therein that her eldest son i.e. the Petitioner herein may kindly be appointed in the bank of the Opposite Party No.4/ Branch Manager, State Bank of India, G.Udaygiri Branch (Main Branch) in any regular vacancy under Rehabilitation Assistance Scheme or on Compassionate Ground for the death of his father, who was working with the bank as a messenger. However, no action was taken against such application and not death benefits were extended to the family of the Petitioner.

5. Since there is other claimants also who claim to be the wife and son of the deceased, they also have the similar aspirations be employed under the Rehabilitation

Scheme, this Court cannot go into the disputed question of fact. Hence, the Petitioner is directed to approach the appropriate court seeking appropriate relief. Thereafter, the Petitioner shall approach the Opposite Parties/State Bank of India. Accordingly, the Opposite Parties/State Bank of India shall consider the grievance of the Petitioner in accordance with law.

6. Accordingly, the Writ Petition is disposed of.
