Heard l e arned counsel for the petitioner and State.

Instant w rit petition is filed by the petitioner for a d irection to the opposite parties for his appointment against Group- C vacant post in any Go v ernment school considering his eligibility as a paraathlete and for h aving received certificate of merit (medal) in ParaAthletic National Championship, 2012.

Learne d counsel for the petitioner would submit t h at on a miscommunicati o n, the case of the petitioner has appare n tly been not considered f or appointment against a vacant Governm e nt post. For the reason s tated, it is claimed that the name of the p etitioner does not find p lace in the selection as at Annexure-2. It is also submitted that the petitioner’s plea is pending decisio n before opposite party No.2 by a representation i.e. Annexur e -4. The contention is t h at the petitioner is a para-athlete and has the eligibility for sel e ction which has not been duly considere d may be by inadvertenc e as he has participated in Para-Athletic National Championship, 2 012.

Mr. Pa n igrahi, learned ASC for the State submits t h at since the grievance o f the petitioner is pending decision before opposite party No.2 by a representation i.e. Annexure-4, if the C o urt is so inclined, it may i ssue direction in that regard for considerati o n and a decision thereo n at the earliest.

Having regard to the facts pleaded on rec o rd and submissions of l e arned counsel for respective parties and s ince the petitioner’s na m e is not included in the selection list for Group-C vacant post des p ite being eligible, the Court is of the view that the representation s u bmitted by him to opposite party No.2 s h ould be examined in a c cordance with law after a proper enq u iry held regarding eligibi l ity.

6. Hence, it is ordered.

In the r esult, the writ petition stands disposed of with a direction to op p osite party No.2 to examine and take a de c ision on Annexure-4, such as, the representation considering of th e matter and eligibility vi s -à-vis the selection to the Group-C post an d to take a decision at t h e earliest preferably within a period of s i x weeks from the date of receipt of a copy of this order with an i n timation about its result t o him immediately thereafter.
