Instant w rit petition is filed by the petitionersfor a d irection to the opposite parties to release the dues considering Annexure3, such as, re p resentation i.e. dated 4^th January, 2023 s u bmitted by him on th e grounds stated therein.

Learne d counsel for the petitioners would submit t hat such engagement o f the petitioners stand revealed from An n exure-1, however, th e dues to which they are entitled have n ot been released till d a te. It is further submitted that the grievan c e of the petitioners s o received by opposite party No.2 has been communicate d to the Additional District Magistrate, Bala n gir vide Annexure-2, h owever, there has been no release of the d ues and payment ther e of.

Mr. Tri p athy, learned AGA for the State would su b mit that the represen t ation i.e. Annexure-3 is stated to be pending consideration before opposite party No.1 and if the C o urt is so inclined, may perhaps direct the said Authority to consider it and pass necessar y order in accordance with law.

Since r e presentation i.e. Annexure-3 is claime d to be pending decision of opposite party No.1, the Court is in c lined to issue directio n to examine it and to take a decision w ithin a stipulated pe r iod towards payment of the daily wage dues in favour of the petitioners, if they are otherwise entitled to .

Hence, it is ordered.

In the r esult, the writ petition stands disposed of with a direction to o pposite party No.1 to consider Annexure- 3 and to take decision on the same at the earliest preferably w ithin a period of six weeks with an intimation about the same to them immediately thereafter.
