Heard learned counsel for the respective parties.

Instant writ petition is filed by the petitioner for a direction to opposite party No.1 to release the unutilized leave salary in his favour taking into account the decision of this Court in W.P.(C) No.3442 of 2016 confirming the order dated 14^th August, 2015 in OA No.2037 of 2015.

Learned counsel for the petitioner submits that the petitioner has moved the Authority concerned with a representation i.e. Annexure-6 for a decision towards release of unutilized leave salary in his favour.

A copy of the order dated 8^th April, 2024 in W.P.(C) No.14291 of 2024 is produced by claiming that similar relief has been granted to the petitioner therein.

Considering the above plea and submission of learned counsel for the petitioner and in view of the contention that the

order of the Tribunal in OA No.2037 of 2015 in a similarly situated case stood confirmed in W.P.(C) No.3442 of 2016, the Court is inclined to direct opposite party No.1 to consider the representation i.e. Annexure-6 submitted by him within a stipulated period.

Hence, it is ordered.

In the result, the writ petition stands disposed of with a direction to opposite party No.1 to consider Annexure-6 and to take a decision vis-à-vis release of unutilized leave salary in favour of the petitioner within eight weeks from the date of receipt of a copy of this order.
