Pradipta Kumar Sena Vs State of Odisha

Vide order dated 07.05.2024, this Court has relegated the parties to the High Court of Orissa Mediation Centre for exploring the possibility of settlement. The petitioners and opposite party No.2 have participated in the mediation and the mediation came out to be successful.

The High Court of Orissa Mediation Centre vide its mediation report dated 09.07.2024 inter alia stated as under:-

<Pursuant to the order of the Hon’ble High Court dtd.07.05.2024, the undersigned was appointed as mediator by the Coordinator of the Centre for settlement of the dispute between the parties.

Both the parties are present along with their respective counsels at High Court of Orissa Mediation Centre, Aain Seva Bhawan, CDA, Cuttack.

During the course of mediation both parties agreed to settle their dispute between them as per the following terms and conditions:-

That, as per the direction of the learned mediator, counsels for both the parties visited the spot on dtd.29.06.2024 and submitted the report (Spot Inquiry) on dtd.05.07.2024 which is attached herewith as a part of record for kind perusal.

Both parties are interested to settle their dispute amicably and in this regard both parties will file a joint affidavit before the Hon’ble Court.

That, both the parties undertake to cooperate each other in quashing of all the criminal proceedings filed against each other.

That, the terms and conditions are being read over by both the parties in presence of their respective counsels and admit the terms and conditions of settlement as per their wish and they agreed to abide by the terms and conditions and thereafter they signed in my presence.

Accordingly, the present Mediation Proceeding is successful and disposed of.=

Pursuant to the successful mediation, the parties are now praying that criminal prosecution initiated by the opposite party No.2 against the petitioners shall be quashed.

Regard being had to the fact that the parties have settled their dispute through mediation, the cognizance order dated 31.05.2021 passed by the learned J.M.F.C. (Rural), Cuttack in G.R. Case No.1113 of 2021 arising out of Jagatpur P.S. Case No.176 of 2021 and the consequential proceedings arising therefrom qua the petitioners are quashed.

The CRLMC is accordingly disposed of.
