2. The petitioner moved an application under Section 457 of Cr.P.C. seeking release of the motorcycle bearing Registration No.OD-07-D-3168 before the learned J.M.F.C., Khallikote. The Court below vide order dated 11.06.2020 rejected the said application. Against the said order, the petitioner has moved Criminal Revision No.2 of 2022 before the learned Additional Sessions Judge, Khallikote, Ganjam and vide order dated 27.03.2023 the revision has been rejected. Hence, the petitioner has approached this Court. 3. Learned counsel for the petitioner submits that both the Courts below has rejected the application under Section 457 of Cr.P.C. on the ground that confiscation proceeding is going on. Therefore, he seeks liberty to withdraw this petition to participate in the confiscation proceeding.

4. Hence, liberty is granted to the petitioner to participate in the confiscation proceeding.
5. The CRLMC is accordingly disposed of.
