14. Considering the matter on the narrated facts and in the circumstances and the submissions advanced on behalf of respective parties noted above, in the interest of justice, the petition for condonation of delay in filing CMAPL is allowed subject to payment of cost of Rs.5,000/- (rupees five thousand) to the counsel for the opposite party Nos.1(a), 1(b), 2(a), 2(b) and 3 by the petitioner.”
He submitted that amount of Rs.5,000/-(rupees five thousand) as directed by this Court as cost in the aforesaid order, on being offered, the learned counsel appearing for the opposite party Nos. 1(a), 1(b), 2(a), 2(b) and 3 has refused to receive on 04.10.2024 by

endorsing the said fact in the Receipt. Copy of receipt showing such refusal by Shri Sarojananda Mishra, learned counsel appearing for opposite parties is filed on 04th October, 2024 at Flag “G”. 3. Faced with such situation, it is deemed that the order dated 26.09.2024 is complied with by the petitioner. 4. In view of the above, it is directed that OJC No.3952 of 1995 be restored to its original file. Registry is instructed to list OJC No.3952 of 1995 before the appropriate roster Bench.
