1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel appearing for the Petitioner and learned Additional Standing Counsel appearing for the Vigilance-Opposite Party. Perused the materials placed before this Court.

The present bail application under Section 483 of B.N.S.S. has been filed by the Petitioner for regular bail in connection with V.G.R. Case No.15 of 2024, arising out of Vigilance, Bhubaneswar P.S. Case No.12 of 2024, pending in the Court of learned Special Judge, Vigilance, Bhubaneswar for alleged commission of offence punishable under Section 7 of P.C. Act.

Learned counsel for the Petitioner submits that earlier this matter was not before any other Bench of this Court. It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since

04.07.2024. He further contended that further custodial interrogation of the petitioner is not required in the present case. In such view of the matter, learned counsel for the Petitioner submitted that the Petitioner be released on bail on any terms and conditions deemed fit and proper by this Court.

Learned counsel for the Vigilance Dept. on the basis of the instruction dated 26.08.2024 issued by the Inspector of Police, Vigilance/I.O. Bhubaneswar Division, Bhubaneswar submitted that further custodial interrogation of the petitioner is not required in the present case.

Having heard learned counsel for the respective parties and on careful consideration of the surrounding facts as well as materials on record, this Court is inclined to release the Petitioner on bail subject to imposition of stringent conditions.

Hence, it is directed that the Petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.30,000/- (Rupees Thirty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned court in seisin over the matter. Release of the petitioner shall be subject to further conditions that:-

I. shall cooperate with the investigation and appear before the Investigating Officer as and when required for the purpose of investigation; and

II. shall not default in attendance of the court during trial on each date of posting.

¶27

Violation of any of the terms and conditions shall entail cancellation of bail.

The BLAPL is, accordingly, disposed of.
