contended that in the meantime investigation has progressed substantially. Learned counsel for the Petitioner further referring to the allegation made in the F.I.R., submitted that on the basis of the co-accused statement, the Petitioner has been implicated in the present case. He further contended that the arrested accused persons confessed before the police that they were selling the contraband articles to 10 persons including the present Petitioner. He further submitted that nothing has been recovered from the exclusive and conscious possession of the present Petitioner. Therefore, the bar under Section 37 of the N.D.P.S. Act would not be attracted to the facts of the present case. He further submitted that although the Petitioner is having two criminal antecedents, however, they are not similar to one involved in the present case. He further contended that the Petitioner belongs to the locality, therefore, there is no chance of his absconding. On such ground, learned counsel for the Petitioner submitted that the Petitioner be released on bail on such terms and conditions that would be imposed by this Court which the Petitioner shall abide by while on bail.
