Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel appearing for the State-Opposite Party.

This is an application under Section 439 of Cr.P.C. filed by the Petitioner for bail in connection with 2(a)C.C. Case No.72 of 2023, arising out of Excise, E.I.&E.B., Unit-II, Cuttack P.R. Case No.03 of 2023-24, pending in the Court of the learned Additional Sessions Judge-cum-Special Judge, Cuttack, for alleged commission of offences punishable under Sections 20(b)(ii)(C)/29/27-A of the N.D.P.S. Act.

Perused the report of the learned 1^st Additional District & Sessions Judge, Cuttack dated 06.09.2024. The said report reveals that only one witness remain to be examined.

In such view of the matter, learned counsel for the Petitioner does not want to press this bail application at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a stipulated period of time.

Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as not pressed, this Court directs the trial court to make every endeavour to conclude the trial as expeditiously as possible within a period of two months from the date of communication of a copy of this order. In the event trial is not concluded within the aforesaid period, it is open for the Petitioner to move the trial court again by filing a fresh bail application. In such event, the trial court shall consider the bail application of the Petitioner on its own merit.
