CORAM: JUSTICE SIBO SANKAR MISHRA ORDER 07.08.2024 Order No. 05. 1. The petitioner is an accused in connection with P.R. No.57 of 20232024 corresponding to Special Case No.4 of 2023 for the offence punishable under Section 20(b)(ii)(c) of the N.D.P.S. Act pending in the Court of the learned Special Judge, Athagarh, District- Cuttack.

2. Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.

3. The allegation against the petitioner is that, on 20.07.2023, when the informant and the staff were performing the patrolling duty, they saw a car, bearing Registration No. OD-02-AJ-4917, coming from Sidhamala Sahi.

They detained the said vehicle, and on search, they recovered three numbers of jerry bags inside the car and those jerry bags were containing 60 kgs. of contraband. Thereafter, the case had been registered. The charge-sheet has already been filed in the present case. The petitioner is in custody since 20.07.2023.

4. The petitioner had approached the learned Special Judge, Athagarh in Special Case No.04 of 2023 praying for grant of bail. The learned Court

below, vide its order dated 26.13.2023, has rejected the bail application of the petitioner. Being aggrieved, the petitioner has filed the present petition

under Section 439 Cr.P.C. praying for enlargement on bail.

5. Taking into consideration the period of custody of the petitioner, the nature of accusation and the quantity of contraband seized, I am inclined to admit the petitioner on bail.

Hence, the petitioner is directed to be released on bail by the learned

Court in seisin over the matter in the aforesaid case on such terms and conditions as it would deem just and proper and also by verifying the similar antecedent if any.
