The petitioner is an accused in connection with

Ghagarbeda P.S. Case No.50 of 2023 corresponding to C.T. Case No.313 of 2023 for the offences under Sections 302/120-B/34 of I.P.C. pending in the Court of the learned S.D.J.M., Karanjia. He is aggrieved by the order dated 21.11.2023 passed by the learned Additional Sessions Judge, Karanjia in B.A. No.187-A of 2023, whereby the bail plea of the petitioner has been turned down. The trial Court has rejected the bail plea on merits and on the ground that the investigation was still going on at that point in time.

Learned counsel for the State submits that after

investigation, charge-sheet has already been filed on 01.01.2024. From the charge-sheet, it reveals that the present petitioner, although is not involved in the commission of crime, however, he is the master mind behind the entire sequence of the event. It is alleged against him that he has paid about Rs.1,60,000/- to three supari killers to eliminate the deceased, who was his business rival. The petitioner is in custody since 04.09.2023.

In view of the fact that the charge-sheet has already been laid down and evidence is already collected by the police regarding the factum of giving supari for killing the deceased namely Kirsan Sinku, I am not inclined to admit the petitioner on bail. The petitioner is granted liberty to approach the trial Court on the changing circumstances to renew his bail plea.
