This is the second bail application U/S.439 of Cr.P.C. by the petitioner for grant of bail arising out of Balliguda P.S. Case No.242 of 2023 corresponding to C.T.Case No.68 of 2023 pending in the Court of learned Addl. District & Sessions Judge-cum-Special Court under POCSO Act, Phulbani for commission of offences punishable under Sections 341/376(2)(n)/ 506 of IPC read with Sec. 6 of POCSO Act, on the allegation of committing rape and aggravated penetrative sexual assault upon the victim. 3. Heard Mr. Akshaya Kumar Sahoo, learned counsel for the petitioner and Mr. Tapas Kumar Praharaj, learned Standing Counsel in the present matter and perused the record. Mr.Akshaya Kumar Sahoo apprises this Court that this is the second bail

application of the petitioner, but no bail application of the petitioner is pending before any other forum except this one. None appears for the victim despite valid service of notice. 4. It is to be mentioned here that learned counsel for the petitioner has made available to the Court the copy of deposition of the victim. 5. After going through the materials placed on record and the evidence of victim, this Court is not inclined to grant bail to the petitioner.

Hence, the bail application of the petitioner stands rejected. However, trial be expedited. 6. Accordingly, the BLAPL stands disposed of. 7. Issue urgent certified copy of the order as per Rules.
