This is an application under Section 439 Cr.P.C.

The petitioner is an accused in connection with Daitari P.S. Case No.3 of 2023 corresponding to G.R. Case No.40 of 2023 for the offence under Sections 147/148/342/302/149 of I.P.C. pending in the Court of the learned Additional Sessions Judge, Keonjhar.

The allegation against the petitioner in the F.I.R. is that, on 16.01.2023 at about 10.00 P.M., the informant lodged a written complaint before the Daitari P.S. alleging therein that his younger brother namely Alekha Dehury @ Saheb Dehury on 14.01.2023 had left the house after taking lunch and did not return. On 16.01.2023,

he received information that his younger brother’s dead body is

lying in a cultivated filed at Masinajodi village. When he reached

the spot, he found that his brother was lying dead and naked. Suspecting that some unknown culprits have committed murder of his younger brother, he lodged this F.I.R.

The petitioner’s bail application was rejected by the Court

¶23

below on 05.01.2024. The trial is in currency and the material witnesses are yet to be examined.

I am not inclined to admit the petitioner on bail at this stage. However, liberty is granted to the petitioner to renew his bail plea after the material witnesses are examined or the petitioner may revive his bail plea after expiry of six months in case the trial is not progressing.

With this observation, the BLAPL is disposed of.
