Heard the learned counsel for the Petitioners and the State.

By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s. 498-A/506/307/34, I.P.C. and Section 4 of the D.P. Act in connection with Kaniha P.S. Case No.101 of 2021 corresponding to G.R. Case No.655 of 2021 pending in the court of the learned S.D.J.M., Talcher.

Learned counsel for the Petitioners submits that, primarily the allegation is attributed to the husband, whereas the present Petitioners are in-law family members of the complainant and there is no specific allegation against any of them with regard to the alleged incident. According to the learned counsel, although the present Petitioners were extended with the benefit under Section 41A, Cr.P.C., but subsequently charge-sheet have been submitted under Section 307, I.P.C. having been added to the charge-sheet along with the existing offences, they apprehend arrest.

Keeping in view the fact that the present Petitioners are in-law family members and the primary allegation is against the husband who is not petitioner here, while this court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrender and move for bail before the learned S.D.J.M., Talcher in G.R. Case No.655 of 2021 within a period of three weeks from today, they shall be allowed to go on bail on such terms and conditions as would be deemed just and proper by the said court. The ABLAPL is disposed of accordingly.
