Heard the learned counsel for the Petitioner and the State.

By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 379, IPC in connection with Jankia P.S. Case No.473 of 2023 corresponding to G.R. Case No.1379 of 2023 pending in the court of the learned J.M.F.C. (Cog.), Khurda.

It is alleged and as reveals from the F.I.R., on 27.12.2023 during night hours some miscreants committed theft of Curb Machine and Stream Pipes of worth Rs.8 lakhs from the company of the informant, while all the staff were sleeping. The present Petitioner is allegedly to be involved in the said theft.

Considering the nature of the allegations, gravity of the offences and the facts and circumstances of the case, while this court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C., (Cog.), Khurda in G.R. Case No.1379 of 2023 within a period of three weeks from today, he shall be allowed to go on bail on such

terms and conditions as would be deemed just and proper by the said court but subject to verification of his criminal antecedent besides the further condition of depositing cash of Rs.7,000/- (Rupees Seven Thousands) by the Petitioner in the manner as would be directed by the court concerned. The ABLAPL is disposed of accordingly.
