Heard learned counsel for the Petitioners and the State.

By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s. 448/294/354/323/325/307/354B/506/341/34 of IPC.

Perusal of the FIR reveals that on 02.04.2024, at about 09.00 P.M, the present Petitioner along with others forcibly entered into the house of the Informant being armed with deadly weapons, abused her in obscene languages, outraged her modesty and also assaulted her son and nephew and threatened her with dire consequences

Considering the submissions of the learned counsels for the parties, nature of allegations, the circumstances appearing, the seriousness and gravity of the offences, while this Court is not

inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrender and move for bail in connection to Bhandaripokhari P.S. Case No.143 of 2024 corresponding to G.R Case No.137 of 2024 pending in the court of learned J.M.F.C. (Cog. Taking-II)., Bhadrak within a period of three weeks hence, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court, but subject to deposit of Rs.1,500/-(Rupees One Thousand Five Hundred only)each by the Petitioner Nos.2, 3, 4, 5, 6 in the manner to be directed by the court to its satisfaction, but further upon verification of the injury report and criminal antecedent of the Petitioner Nos. 2, 3, 4, 5, 6.

If the injuries are found to be grievous in nature inflicted to the vital part of the body and there appears criminal antecedent standing to the credit of the Petitioner Nos. 2, 3, 4, 5, 6, this order shall not be given effect to.

The ABLAPL is disposed of accordingly.
