Heard learned counsel for the Petitioners and the State.

By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s. 341/323/294/354/506/34 of IPC.

Perusal of the FIR reveals that on 22.02.2023 at 12 Noon, while Informant plucked papaya from her tree, one papaya fall down the land of the present Petitioner and when the Informant asked to Sachhidananda Mohapatra for give the papaya, suddenly Sachhidananda Mohapatra abused the Informant in obscene languages restrained her. It is further alleged that the present Petitioner along with others threatened the Informant with dire consequences.

Considering the submissions of the learned counsels for the parties, nature of allegations, the circumstances appearing, the

seriousness and gravity of the offences, while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrenders and moves for bail in connection to G.R. Case No.141 of 2024 arising out of Tirtol P.S. Case No.104 of 2024 pending in the court of learned J.M.F.C., Tirtol within a period of three weeks hence, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court, but subject to deposit of Rs.750 /- (Rupees Seven Hundred Fifty only) each in the manner to be directed by the court. The ABLAPL is disposed of accordingly.
