This writ petition has been filed assailing the order dated 28^th October, 2010 passed by learned Civil Judge (Junior Division), Nimapara in C.S. No.117 of 2008, whereby an application to stay further proceeding of the suit till disposal of Revision Case No.537 of 2008 pending before the Commissioner, Consolidation, has been rejected.

Mr. Pradhan, learned counsel for the Petitioner by filing a memo submits that he has no instruction in the matter. Memo so filed is taken on record.

In view of the memo filed, the writ petition stands dismissed for non-prosecution.

Interim order dated 2^nd August, 2011 passed in Misc. Case No.11471 of 2011 stands vacated.
