Heard learned counsel for the Petitioner.

This writ petition has been filed by the PetitionerPrasanta Kumar Nayak challenging the advertisement made in the daily Odia local Newspaper “The Sambad” dated 16.05.2023 relating to tender notice for cleaning and sanitation at premises of 05 LLPD Dairy of OMFED at Arilo.

Learned counsel for the Petitioner submitted that there was an agreement between the Odisha State Cooperative Milk Producers Federation Limited and M/s. Active Security & Intelligence Services on 30.11.2021, which is valid for a period of one year with effect from 01.11.2021 and in the said agreement it was specified that “the agreement is terminable with one-month notice

in writing or payment of one-month charges from either side during the agreement period” and in spite of the fact that performance of the Petitioner is quite satisfactory, the tender notice has been floated, which is not proper and justified. Learned counsel for the Petitioner further submits that the Petitioner has filed a representation dated 23.05.2023 before the Chairman-cum-Managing Director, OMFED, Opposite Party No.1 (Annexure-5) ventilating his grievance and the same has not been considered and, as such, Opposite Party No.1 may be directed to consider the same.

Considering the limited nature of grievance of the Petitioner in the writ petition and without expressing any opinion on the merits of the case, this writ petition is disposed of directing Opposite Party No.1 to consider the representation of the Petitioner under Annexure-5 within a period of one week from the date of production of a certified copy of this order along with a copy of the writ petition and pass necessary reasoned order after giving an opportunity of hearing to the Petitioner and communicate the result of such exercise to the Petitioner.
