However, the Writ Appeal preferred by the State-Opposite Parties was disposed of at the stage of admission without issuing notice to the present Petitioner, who was a respondent in the Writ Appeal. Therefore, it is contended by the leaned counsel for the Petitioner that the aforesaid fact of acquittal in the Vigilance case could not be brought to the notice of the Division Bench while passing the final order on 27.03.2023. On perusal of the record, it appears that vide order dated 27.03.2023 the Division Bench disposed of the Writ Appeal by setting aside the order dated 20.07.2021 passed by the coordinate Bench on the ground that no opportunity of hearing was given to the State-Opposite Parties at the time of hearing of the Writ Petition. However, when the matter was taken up for hearing, it was brought to the notice of this Court that another Writ Petition, which has been filed by the Petitioner bearing W.P.(C) No.13676 of 2023 for a direction to the Opposite parties to consider the case of the Petitioner keeping in view the fact that the Petitioner has been acquitted in the Vigilance case. The said Writ Petition has been disposed of vide order dated 02.05.2023. Therefore, this Court is of the considered view that the present Writ Petition has become virtually infructuous.
