“I am directed to say that as per opinion of the Finance Department, this Department has filed writ application bearing WP(C) No.10396/2006 before the Hon’ble High Court challenging the impugned order dated 19.09.2005 of the hon’ble OAT in OA No.1702(c)/05 and Misc. Case No.9254/2006 for stay of operation of the above orders.
But, on view of the orders of Hon’ble High Court passed in W.P.(c) No.1071/2005 Government in Finance Department have decided that instead of filing writ application before the Hon’ble High Court against such order of Hon’ble OAT, Administrative Department may implement the direction of the Hon’ble OAT to avoid for the litigation in the matter if it is same in nature to that of OA No.2471(c)/2000 Sri Chhanda Charn Mohapatra –Vrs.State(Copy of the Finance Department Letter No.17136/F.’dated 04.04.2007 enclosed)
In view of above, this Department have decided that as the case of Sri Arjun Ch. Rout is similar to that of the case of Sri Chhanda Charan Mohapatra, the writ application bearing WP(C) No.10396/06 along with the Misc. Case No.9254/06 filed earlier before the Hon’ble Court may be withdrawn.
As such you are requested to kindly take early steps for withdrawl of the aforesaid writ petition under intimation to
