2. Heard Mr. A. Tripathy, learned counsel for the Petitioner and Mr. R. N. Panda, learned counsel appearing for the Opp. Party.

3. Pursuant to the order passed by this Court on 08.02.2023, Mr. A. Tripathy, learned counsel for the Petitioner contended that even though the Petitioner had agreed for a mutual decree of divorce subject to payment of permanent alimony of Rs.10,00,000/(Rupees Ten Lakhs) and the Opposite Party expressed his willingness to pay sum of Rs.8,00,000/- (Rupees Eight Lakhs), but now the Petitioner is not ready and willing to go for divorce by accepting a sum of Rs.10,00,000/- (Rupees Ten Lakhs).

4. In view of such position, this Court after considering the grounds taken in the Transfer Petition the decisions governing the field and the objection filed by Mr. R.N. Pand is inclined to transfer the matter in C.P. No.509 of 2022 pending before the learned Family Judge, Bhubaneswar. This Court accordingly directs learned Family Judge, Bhubaneswar to transfer C.P. No.509 of 2022 to the Court of learned Judge, Family Court, Nayagarh forthwith on receipt of this order.

5. It is observed that on receipt of the notice from the transferee Court, the Petitioner shall file her written statement within a period of one month positively. It is also observed that the Petitioner will cooperate for early disposal of the matter and she will not seek for any unnecessary adjournment during trial of the proceeding before the learned Family Court, Nayagarh. Learned Family Judge, Nayagarh is directed to take effective steps for disposal of the matter as expeditiously as possible.

6. The Transfer Petition is disposed of accordingly.
