3. 1. This matter is taken up through Hybrid
Arrangement.
2. Heard learned counsel for the petitioner and learned
counsel for the State.
3. In this CRLMP, the petitioner seeks a direction from
this Court to the opposite parties to release the vehicle in
favour of the petitioner which was seized by the Forest
Authority while constructing of a public road.
4. Learned counsel for the petitioner submits that the
petitioner is the owner of the vehicle bearing Registration
No.OD-17-D-0242. The said vehicle was seized by the
opposite parties while removing earth for construction of
a public road for the benefit of the public. The alleged

vehicle was detained by the Forest Range Officer with an allegation of violation of Forest Act. In such background, he prays that liberty may be granted to the petitioner to approach the Forest Ranger Officer, Sonepur Range (opposite party no.4) by filing an application for releasing the vehicle.
