Learned counsel for the appellant submitted that this is the third successive bail application of the appellant and when he approached this Court last time for bail in CRLA No. 357 of 2020, the same was rejected as per order dated 26.08.2021 and direction was given to the learned trial Court to take effective steps for early disposal of the case against the appellant by splitting up of the file since the other co-accused persons have absconded. Learned counsel further submitted that the position has not changed since then and charge is yet to be framed. He however, submitted that some of the co-accused persons, namely, Kanhu Chhatoi, Goutam Polai and Jagannath Lenka have already granted bail. He files the bail order copies of co-accused persons, namely, Kanhu Chhatoi and Goutam Polai in Court today, which are taken on record and the bail order copy of Jagannath Lenka has been annexed to the appeal memo as Annexure-3. Learned counsel has filed the certified copy of the order-sheet of the learned trial Court to substantiate his argument that no trial has been commenced. It is further submitted that charge sheet has been submitted against the appellant under sections 364/302/201/120-B/34 of the Indian Penal Code read with sections 25(1-B)(a)/27 of the Arms Act and section 3(2)(v) of the S.C. & S.T.
