The Petitioner is an accused in Special G.R. Case No.97 of 2022 pending on the file of learned Sessions Judge-cum-Special Judge, Malkangiri, arising out of Kalimela P.S. Case No.155 of 2022 for commission of the alleged offence under Sections 20(b)(ii)(C)/25 of the N.D.P.S Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned learned Sessions Judge-cum-Special Judge, Malkangiri by order dated 12.01.2023 in the aforementioned case, the present BLAPL has been filed.

Perused the report received from the learned Court in seisin indicating that out of 12 charge sheeted witnesses 7 witnesses have already been examined and the case is likely to be disposed of by end of 4^th quarter, 2023.

Tasking note of the same and keeping in view the quantity of the contraband (ganja) to the tune of 79 Kg. 900 grams seized, the manner of seizure and the Petitioner being a flight risk, this Court is not inclined to entertain this bail application at this stage.

Leave is granted to the Petitioner to renew his prayer in case the trial is not concluded by end of 4^th quarter 2023 as stated in the letter of the learned Special Judge, Malkangiri.

Registry is requested to communicate this order to the learned Court in seisin.

Accordingly, the BLAPL stands disposed of.
