The Petitioner is an accused in connection with S.C. Case No.34/14 of 2021, pending before the Court of the learned Addl. Sessions Judge, Sonepur, arising out of Sonepur P.S. Case No.13 of 2021 for alleged commission of offences under Sections 376(D)/341/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Sonepur, by order dated 13.09.2023 in the aforementioned case, the present BLAPL has been filed. 4. Perused the report of the learned Addl. Sessions Judge, Special Judge, Sonepur indicating that the only I.O is to be examined and the case has been posted to 18.12.2023 for the said purpose. 5. Learned counsel for the State assures this Court that the I.O. shall be produced on the said date for examination without fail.

Taking note of the same the matter is disposed of and the learned Court in seisin is requested to conclude the trial by the end of January, 2023, as stated in the report(supra).

Before parting with the case, this Court disapproves the manner in which the report has been submitted by the learned Court in seisin, wherein there is no response to the specific query of the Court as to why there is no reference to the order of this Court when the same was admittedly produced by the learned Additional Sessions Judge-cum-Special Judge.

Learned Court in seisin is advised to be more careful in future. Necessary communication in this regard be sent to the concerned learned Judge by the Registrar(Judicial) though the District Judge and the matter be also brought to the kind notice of the Hon’ble Administrative Judge. Registrar(Judicial) is requested to do the needful.

Copy of this order be made over to the learned counsel for the State to take necessary follow up action.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per rule.
