Heard learned cousin for the petitioners and learned counsel for the State.

The petitioners are apprehending arrest in connection with Sukinda P.S. Case No.169 of 2023 corresponding to C.T. Case No. 319 of 2023 pending in the court of learned J.M.F.C.-cum-Gramya Nyalaya, Sukinda for the alleged commission of offence under Sections 341/294/323/325/307/379/506/34 of IPC.

It is alleged that the petitioners being armed with deadly weapons assaulted the informant causing several injuries. They also stole Rs.30,000/- from his pocket. It is submitted that the co-accused persons have been released on bail.

Such being the case, while not being inclined to

grant anticipatory bail, the ABLAPL is disposed of granting liberty to the petitioners to surrender before the court below and to move for bail which shall be disposed of on the same day in the first hour. In case of rejection, it shall be open to the petitioners to move the higher forum on the same day, for which the records including the case diary and injury report shall be transmitted at their cost. The higher forum shall also dispose of the bail application on the same day, having due regard to the principal of parity.
