Balaram @ Balia Bindhani Vs State of Odisha

The petitioner is apprehending arrest in connection with Raibania P.S. Case No. 62 of 2023 corresponding to C.T. Case No. 331 of 2023 pending in the court of learned J.M.F.C., Jaleswar for the alleged commission of offence under Sections 302/34 of IPC.

Learned State Counsel has produced the case diary. Perused the 161 Cr. P.C. statement of one Ganesh Soren, which reveals that the petitioner is alleged to have taken the principal accused on his motorcycle after commission of the occurrence and left him in a jungle. Save and except the above there is no other allegation against the petitioner.

Having regard to the nature of accusations and the materials on record, while not being inclined to grant anticipatory bail to the petitioner, the ABLAPL is disposed of granting liberty to the petitioner to surrender before the court below within two week from the date of receipt of certified copy of this order and to move for bail. In such event, he shall be released on bail on such terms and condition as the court below may deem fit and proper to impose.
