Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending arrest in connection with Delanga P.S. Case No. 278 of 2023 corresponding to G.R. Case No. 684 of 2023 pending in the court of learned J.M.F.C., Pipili for the alleged commission of offence under Sections 34/365/506 of IPC.

It is alleged that the petitioners kidnapped the son of the informant while he was purchasing vegetable from the market.

Learned State Counsel submits on instructions that the investigation has revealed that the injured

sustained some injuries. Such fact is not mentioned in the FIR.

Looking at the nature of accusations and the materials on record, while not being inclined to grant anticipatory bail, the ABLAPL is disposed of granting liberty to the petitioners to surrender before the court below and to move for bail which shall be disposed of on the same day in the first hour. In case of rejection, it shall be open to the petitioners to move the higher forum on the same day, for which the records including the case diary and injury report shall be transmitted at their cost. The higher forum shall also dispose of the bail application on the same day having due regard to the principle of parity.

The ABLAPL is disposed of.
