Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending arrest in connection with Nikirai PS Case No. 327 of 2023 corresponding to G.R. Case No. 574 of 2023 pending in the court of learned J.M.F.C. (Cog. Taking Court), Kendrapara for the alleged offence under Sections 147/148/294/323/325/379/506/149/ of IPC read with Sections 25/27 of Arms Act.

Learned State Counsel has obtained instructions that the petitioner has two criminal antecedents and that the injury is simple in nature.

Considering the nature of accusations and the materials on record, while not being inclined to grant

anticipatory bail to the petitioner, the ABLAPL is disposed of granting liberty to the petitioner to surrender before the court below within two weeks from the date of receipt of certified copy of this order and to move for bail. In such event, he shall be released on bail on such terms and condition as the court below may deem fit and proper to impose including the following conditions:-

i. He shall appear before the IIC of Nikirai police station on every Sunday at 10.00 A.M. for a period of six months and such fact shall be certified by the IIC to the concerned Court once a month.

ii. He shall personally appear before the trial Court on each date of posting of the case without seeking representation.

The ABLAPL is disposed of.

¶23

Urgent certified copy of this order be granted on proper application.
