The Vakalatnama filed on behalf of Mahanadi Coalfields Limited (MCL) through Mr.Rakesh Sharma, learned counsel is taken on record.

Heard Mr. M.K.Mohanty, learned counsel for the petitioner and Mr. Rakesh Sharma, learned counsel for the opposite parties.

The prayer in the writ petition is to direct the opposite parties particularly;

“xx xx Opposite Party No.4 to issue Invitation to the petitioner for attending the Prize Distribution Ceremony of the Annual Mines Safety Fort Night- 2021-2022 to be held on 23.04.2022 at 4 P.M. like the President of other Trade Unions functioning under Jagannath Area, Mahanadi Coal Ltd. And pass such other or further order or orders as are deemed just and proper.”

The prayer in the I.A. is quoted below.

“The Petitioner most respectfully prays that the Hon’ble court may be graciously pleased to allow the petition, direct the Opp. Parties to make arrangement for the petitioner to attend the Prize Distribution Ceremony of the Annual Mines Safety Fort Night -2021-2022 be held on 23.04.2022 at 4 P.M. like other Office Bearers of five Trade Unions pending adjudication of the writ petition and pass such other or further order/orders as are deemed just and proper.” 6. Learned counsel for MCL has appeared pursuant to notice issued through special messenger. Documents filed on behalf of the opposite party are taken on record.

On a bare perusal it can be seen that prayer in the I.A. is in effect same as in the writ petition.

Taking note of submission of the learned counsel for the parties and on a conspectus of materials on record, this Court is not inclined to entertain the writ petition.

It is needless to state here that petitioner’s nonattendance of the Prize Distribution Ceremony of the Annual Mines Safety Fort Night- 2021-2022 be held on 23.04.2022 at 4 P.M. shall have no effect on the purported status of the petitioner as President of Coal India SC/ST Employees’ Association (CISTEA) Jagannath Area, Mahanadi Coal Ltd.
