Puspalata Mohanty Vs State and Ors.

This petition was filed way back in 12^th April, 2014 by a resident of Gultua in the district of Bhadrak claiming that her son, working as an Officer in Axis Bank and staying in a rented house at Cuttack, had gone missing. She mentioned that she had lodged a report to the I.I.C., Badamabadi on 6^th January, 2014. The grievance of the Petitioner was that the police has not taken any action to trace out her son and accordingly the present habeas corpus petition was filed.

The police have apart from filing a counter affidavit, filed status reports. The police have concluded that the allegations in the petition against Opposite Party No.5 with regard to her alleged

role is unfounded and that she has no connection with the Petitioner having gone missing.

Several status reports have been filed over the years before this Court by the police. In the over seven years during which the present petition has been pending, despite best efforts, the police have been unable to trace out the Petitioner’s son.

The Court sees no purpose being served by keeping the petition pending indefinitely. It is nevertheless directed that once in every two months the Petitioner will be kept informed by the police of the status of the investigation.
