19.03.2021 Heard Mr. Mohanty, learned counsel for the Petitioner and Mr. S.N. Mishra, learned Addl. Government Advocate for the State-Opposite Parties 1 to 3.

This writ petition has been filed for a direction to restrain the Tahasildar, Balipatna-Opposite Party No.2 from implementing the order dated 24.06.2013 passed by the Commissioner, Consolidation & Settlement, Odisha, Bhubaneswar in R.C. Case No. 54 of 2007 as well as the order dated 19.03.2020 passed by the Addl. Sub-Collectorcum-Consolidation Officer, Bhubaneswar in Remand Revision Case No. 54 of 2007.

Mr. Mohanty, learned counsel for the Petitioner submits that assailing the order dated 19.03.2020 passed by the Addl. Sub-Collector-cum-Consolidation Officer, Bhubaneswar in Remand Revision Case No. 54 of 2007, the Petitioner has filed Consolidation Appeal Case No. 4 of 2020, which is pending before the Deputy Director, Consolidation, Bhubaneswar, but he is not in a position to move the same as the said court is not functioning.

In that view of the matter, this Court vide order dated 16.03.2021 directed the learned Addl. Government Advocate for the State, Mr. S.N. Mishra, to take instruction in the matter. Today, Mr. Mishra, learned Addl. Government Advocate for the State, on instruction, submits that the court of Deputy Director, Consolidation,

Bhubaneswar has started functioning since January, 2021, after the restriction of COVID-19 is lifted.

Taking into consideration the submissions of learned counsel for the parties, this writ petition is disposed of with a direction that the Petitioner is at liberty to move the Consolidation Appeal Case No. 4 of 2020 pending Deputy Director of Consolidation, Bhubaneswar-Opposite Party No.3 and in order to enable him to move an interim application before the Opposite Party No.3, the order dated 19.03.2020 passed by the Addl. Sub-Collector-cumConsolidation Officer, Bhubaneswar is stayed for a period of four weeks.
