Heard Mr.Srinivas Mohanty, learned counsel for the petitioner and Mr.Pravakar Behera, learned Standing Counsel for Transport department.

In the present writ application, the petitioner has sought for a direction to the opposite party no.2 to cause registration of the vehicle of the petitioner without levying any fines provided under Rule 81 of the Central Motor Vehicle Rules.

Mr.Pravakar Behera, learned Standing Counsel for Transport department has fairly submitted that this Court in W.P.(C) no.18124 of 2019 have struck down the levy of additional fee under Rule 81 of Central Motor Vehicle Rules, 1989. He further submits that pursuant to the judgment of this Court Notification No.9445 dated 01.12.2020 has been issued wherein the levy of additional fee has been waived for the time being awaiting the decision of the Hon’ble Supreme Court in the Civil Appeal No.11216 of 2017.

In that view of the matter, the grievance of the petitioner appears to have been redressed.

Considering the limited nature of grievance of the petitioner and without delving into the merits of the matter, the writ petition is disposed of with a direction that the opposite party no.2 shall do well to cause registration of the vehicle of the petitioner without

levying any fines as per Rule 81 of the Central Motor Vehicle Rules, 1989 as expeditiously as possible. With the aforesaid observation and direction the writ application is disposed of.

As restrictions are continuing for COVID-19, learned counsel for the parties may utilize the soft copy of this order available in the High Court’s Website or print out thereof at par with certified copies in the matter prescribed, vide Court’s Notice No.4587, dated 25.03.2020.
