The petitioner has filed this writ petition seeking direction to opposite parties no.1 and 2 to allow the husband of the petitioner with grade pay of Rs.5400/- on 2^nd RACP benefit and grade pay of Rs.6,600/- on 3^rd financial up-gradation under RACPS w.e.f. 01.01.2013 as well as to continue with the scale of pay of Rs.15600/--Rs.39100/- till the date of his retirement i.e. 31.05.2013 with all consequential and arrear financial benefits modifying the order dated 26.11.2016 granting 2^nd & 3^rd RACP in favour of the husband of the petitioner under Annexure-6 and further seeks direction to the opposite parties to fix the pay appropriately and draw the pension and retirement benefit of her husband as per the re-fixed pay along with the arrear accrued thereof and fix the family pension appropriately.

In course of hearing, learned counsel for the petitioner stated that highlighting the grievances, the petitioner has made representation to opposite party no.2 vide Annexure-11 and the same may be directed to be considered taking into consideration Annexurex-7 & 8 within a stipulated time.

Considering the limited grievance of the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.2 to consider the representation filed by the petitioner vide Annexure-11 and pass appropriate order in accordance with law taking into consideration Annexures-7 & 8 within a period of three months from the date of production of certified copy this order.
