The petitioner has filed this writ petition seeking to quash the award dated 26.12.2006 and direct to rehear the Dispute Case No. 61 of 2006 of the file of the Deputy Registrar, Co-operative Society, Dhenkanal.
Mr. D.K. Mohanty, learned Addl. Standing Counsel appearing for the State submits that on the date of hearing, the petitioner did not appear, thereby, the matter has been disposed of. The order impugned is appealable one.
After considering the contentions raised by learned counsel for the State, it appears that the petitioner has not been given opportunity of hearing on the date fixed. Thereby, the order dated 26.12.2006 passed in Dispute Case No. 61/2006 is hereby quashed and the matter is remitted back to the Deputy Registrar, Cooperative Societies, Dhenkanal Division, Dhenkanal to rehear the matter afresh by giving opportunity of hearing to all the parties.
With the above observation and direction, the writ petition stands disposed of.
