The Petitioner by filing this writ application has prayed for a direction to the Opposite Party Nos. 1 and 2 to take prompt steps for the allotment of the premises in question in his favour as per his application under Annexure-2.
Learned counsel for the Petitioner submits that this Petitioner is in possession of the said land belonging to the State in the Department of the General Administration, Bhubaneswar since 1962 and for that reason, he has filed an application before the Opposite Party No. 1 on 26.12.2017 for settlement of the land in his favour which is still pending. At this stage, he comes up with the limited prayer as to the disposal of the writ application with a direction to the Opposite Party No. 1 to consider and dispose of the pending application of the Petitioner in accordance with law.
Learned Additional Advocate submits that on the face of the facts narrated in the petition as at Annexure-2, the Petitioner has no case even if his claim as to possession for a long period is accepted for a moment and that is of no significance at all. He further submits that the piece of Govt. land is situated in an important locality within the jurisdiction of Bhubaneswar Municipal Corporation for which the application of the Petitioner if has been so received has not
been considered as per the Govt. Policy.
Considering the submissions made and on going through the averments taken in the petition as also the documents annexed thereto, further taking into account the limited nature of prayer; this writ application stands disposed of with the observation that in the event the Petitioner files an application describing his grievance for redressal within fifteen days hence, the Opposite Party No. 2 would do well to consider and dispose of the same in accordance with law within three weeks thereafter.
