In course of hearing of the Appeal in the matter of admission, learned counsel for the Appellant submits that this Appellant, who is admittedly the landlord of the shop room in question which is occupation of the Respondent as the tenant would now be filing suit for eviction of the Respondent, further claiming and other reliefs as to realization of rent, damage etc.
He, therefore, prays for withdrawal of this Appeal so as to institute the suit as aforesaid before the Competent Court having the jurisdiction.
In view of the above, the Appeal stands disposed of as withdrawn.
