Heard Mr. Jayadeba Behera, learned counsel for the petitioners, learned Addl. Government Advocate and Mr.A.K.Nath, learned counsel for the Commissioner of Endowments.

In this writ petition, the petitioner has prayed the following reliefs:-

“Issue Rule NISI, asking the opp. parties to show cause as to why they shall not be directed to offer the traditional Chacheri Bhog of the Lord Shree Rameswar Dev in the village of petitioners for the ensuing Dola festival by handing over the charges to the Executive Officer Balugaon NAC and if the opp. parties do not show cause or show insufficient cause, then issue a writ of mandamus in nature thereby directing to the concerned opp. parties to perform the traditional Chacheri Bhog of Lord Shree Rameswar Dev in the village of petitioners for the ensuing Dola festival by maintaining the COVID-19 Guidelines in the interest of justice.”

Mr. Nath brought to our notice that vide letter No.1860 dated 03.03.2021, Annexure-5, the Executive Officer, Balugaon NAC has been declared as Interim Managing Trustee by the Commissioner of

Endowments, Odisha, Bhubaneswar. So part of the prayer of the petitioners has become redundant.

However, we direct the Executive Officer, Balugaon NAC to perform the Dola festival of the deity, i.e., Lord Shree Rameswar Dev during Dola as per tradition by offering Chacheri Bhog. We further direct that the Dola festival of Lord Shree Rameswar Dev shall be performed strictly in accordance with the norms and guidelines of “COVID-19” issued by the Govt. of Odisha in connection with such festival.

With the above observations and directions, the writ petition is disposed of.

Let a copy of this order be communicated to the opp. party No.7-Executive Officer, Balugaon NAC and the other opp. parties for compliance. Requisites for which shall be filed within three days.
