CRLMC No.165 of 2021
Heard learned counsel for the petitioners as well as learned
counsel for the State.
It is submitted by learned counsel for the petitioners that the petitioner no.1 was earlier released on bail on 16.05.2009 and petitioner nos.2 to7 were earlier released on bail on 16.03.2009 in G.R. Case No.363/2008 corresponding to Kodala P.S. Case No.131/2008 pursuant to order dated 09.01.2009 passed in BLAPL No.17362 of 2008 of this Court, for alleged offences under Secs.147/148/323/324/379/452/ 354/506/149, I.P.C. Subsequently due to their non-appearance before the court below, for the reason of communication gap with the lawyer, the NBW of arrest was issued against them by order dated 08.05.2018.
Thus considering the limited nature of prayer and after hearing learned counsel for the State, the CRLMC is disposed of with a direction that in the event the petitioners surrender on or before 18th May, 2021 before the learned court below and moves for bail, they be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter.
It is made clear that failing to surrender within the time stipulated above, this order shall not be given effect to.
The CRLMC is disposed of.
