Heard Mr. S. Panda, learned counsel for the Petitioner and learned State counsel.
This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner Ankit Apat in connection with G.R. Case No.1232 of 2020 arising out of Kinjirikela P.S. Case No.70 of 2020 pending in the court of learned S.D.J.M., Sundargarh for alleged commission of offence under Sections 457/380 of the Indian Penal Code.
It is submitted on behalf of Petitioner that he is inside custody since 25.09.2020 and though there are some reported criminal antecedents against him but in all such cases he has already been released in bail except in one case. It is further submitted that the investigation in the present case has been completed and charge-sheet has already been submitted.
After hearing learned State counsel and considering the period of detention of the Petitioner inside custody, vis-à-vis the nature of allegations, it is directed to release the Petitioner on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the condition that, the Petitioner shall not be involved in any other offence while on bail and shall appear before the I.I.C., Kinjirikela police station once in each week till completion of trial.
The BLAPL is accordingly disposed of.
