Heard Mr. Mishra, learned counsel for the Petitioner and Mr. Pradhan, learned counsel for the Opposite Party.
This CMP has been filed assailing the order dated 21st December, 2019 passed by learned Civil Judge (Senior Division), Talcher in Execution Case No. 17 of 2019 (arising out of C.S. No. 1 of 2016), whereby he directed the Petitioner to pay maintenance of Rs.10,000/- per month to the Opposite Party from the date of filing of the suit and further directed to pay arrear maintenance amount in two equal monthly installments.
Taking into consideration the nature of dispute, this Court vide order dated 4th February, 2021 sent the matter to Mr. Bibekananda Bhuyan, learned Advocate and Trained Mediator to mediate the matter. Accordingly, he submitted his report on 28th February, 2021 at Flag-C.
Perused the report. On perusal of the mediation report submitted by Mr. Bhuyan, learned Advocate and Trained Mediator, nothing remains to be adjudicated in this CMP. It is, therefore, directed that parties shall produce a certified copy of the aforesaid mediation report before learned Civil Judge (Senior Division), Talcher in Execution Case No. 17 of 2019 and in that event, learned executing court shall consider the same and pass appropriate orders.
