This is an application for bail under section 439 of Cr.P.C. in connection with Gorumahisani P.S. Case No.09 of 2020 corresponding to S.T. Case No. 54 of 2020 pending in the file of learned Addl. Sessions Judge, Rairangpur for alleged commission of offence under section 302 of the Indian Penal Code.
The prayer for bail of the petitioner was rejected by the learned Addl. Sessions Judge, Rairangpur vide order dated 15.09.2020.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 20.02.2020 and he has been charge sheeted under section 302 of the Indian Penal Code and the occurrence in question took place on 17.02.2020 and the deceased Sombari Majhi is the wife of the petitioner and it is submitted that there are no eye witnesses to the occurrence and therefore, the bail application of the petitioner may be favourably considered.
