The matter is taken up through Hybrid arrangement (video conferencing/ physical mode). Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with S.T. Case No.217 of 2015 (A) arising out of Aul P.S. Case No.104 of 2014 pending in the Court of learned Sessions Judge, Kendrapara for alleged commission of offences punishable under sections 147/148/307/302/586/114/149 of the Indian Penal Code and section 27 of the Arms Act.

The petitioner moved an application for bail before the Court of learned Session Judge, Kendrapara which was rejected on 28.08.2020.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 15.12.2018 and he has been charge sheeted under sections 147/148/307/302/506/114/149 of the Indian Penal Code and section 27 of the Arms Act and further submission that there was political hostility between the parties and the petitioner used lathi in assaulting the deceased Arjuna Charan Rout and after going through the statement of eye witness Tarun Kumar Jena placed by the learned counsel for the State

as well as the post mortem report, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper with further conditions that the petitioner shall not try to come in contact with any prosecution witnesses or tamper with the evidence and he shall appear before the learned trial Court on each date when the case would be posted for trial.

Violation of any of the terms and conditions fixed shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
